These Terms & Conditions ("Terms") govern the use of the Kapturas website, services, and SMS messaging program ("Kapturas," "we," "us"). By creating an account, using the service, or opting in to our messaging program, you agree to these Terms.
1. The service
Kapturas is a job documentation service for trade contractors. It converts contractors' voice notes, texts, and photos into structured change orders and damage documentation, and delivers job-related notifications to contractors and, at the contractor's explicit direction, to their end clients.
2. SMS messaging program
Program name: Kapturas Job Documentation Alerts.
Program description: Kapturas sends job documentation and change order text messages, including confirmations to contractors, change order approval requests to a contractor's end clients, approval status updates, and reminders about pending items. Messages are transactional and conversational — related to active jobs. This is not a marketing program.
Message frequency: Message frequency varies based on job activity.
Cost: Message and data rates may apply. Charges are billed by your mobile carrier.
Opt-out: You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will confirm your unsubscribe status and you will no longer receive SMS messages from us. To rejoin, text START to the same number.
Support: Reply HELP to any message for help, or contact us at support@kapturas.com.
Consent: Contractors consent to receive messages when they create a Kapturas account and accept these Terms. End clients receive job-related messages only in connection with work they hired the contractor to perform; the contractor is responsible for obtaining their client's consent to receive job communications before any message is sent. Consent to receive messages is not a condition of any purchase.
Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
3. Contractor responsibilities
- Provide accurate rates, job details, and client contact information.
- Obtain your client's consent before directing Kapturas to send them job-related messages.
- Review every change order and report before it is sent; nothing is sent to a client without your explicit confirmation.
4. No guarantee of outcomes
Kapturas documents facts. We do not negotiate insurance policies, act as a public adjuster, provide legal advice, or guarantee that any change order will be approved by a client or that any insurance claim will be approved or paid by a carrier.
5. Acceptable use
You may not use Kapturas to send unlawful, deceptive, or unsolicited marketing messages, or to violate any applicable law, including the Telephone Consumer Protection Act (TCPA).
6. Intellectual property
The Kapturas name, site, and software are our property. Content you submit (voice notes, photos, job details) remains yours; you grant us a license to process it solely to provide the service.
7. Limitation of liability
The service is provided "as is." To the maximum extent permitted by law, Kapturas is not liable for indirect, incidental, or consequential damages arising from use of the service.
8. Changes
We may update these Terms from time to time. The current version will always be available at this page with its effective date. Continued use of the service after changes constitutes acceptance.
